ARTICLE 1, PREAMBLE

Us, together as a whole, as the United Penguin Army and the Government Order of the United Penguin Army, join together in unity to establish justice and enhance security to the world of club penguin armies for the greater of all penguin-kind.

ARTICLE 2, MISSION STATEMENT

The United Penguin Army and the Government Order of the United Penguin Army will fight for peace and defend for justice. As well as fighting for justice and defending for peace.

ARTICLE 3, DEMOCRATIC STATEMENT

The Government Order of the United Penguin Army is classified as a Democracy government system, meaning that the presidents are elected with a vice president to follow behind. Senate members are also elected, and the judicial court system are elected with a chief justice appointed by the president. No person is above each other, creating an even government.

ARTICLE 4, DEMOCRATIC POSTIONS

Section A: Executive Branch

President:  He/She is elected, and is the leader of the armed forces. This person serves for a term of 6 months and can be removed from their position by impeachment, resignation, or death. The President can be re-elected.

Vice President: He/She is the President’s previous running mate, and is second under the leader of the armed forces. This person serves for a 6 month term and can be removed from their position by impeachment, resignation, or death. The Vice President can be re-elected along with the President.

Secretary of State: He/She is appointed by the President and is under the command of the President and Vice President. This person informs other soldiers of things that the President or Vice President is unavailable. This person serves for as long as the president and vice president, and leaves office if the President is impeached and if both the President and Vice President resign.

Section B: Legislative Branch

Head of the House: This person, is chosen by the President. And can be impeached by the Senate or the President. This person is designated to keep things on task and in order and pass the approved bill to the president and/or vice presidents.

Officer of the House: This person, is chosen by the Head of the House because this is his/her assistant. If the Head of the House is vetoed by the Senate, or the President, the president makes the decision for keeping this person the Officer of the House or promoting to the Head of the House, and if approve of neither, this person leaves their position. This person can pass an approved bill to the president. This person will also serve as the Head of the House when the Head of the House is not present.

Top Senators: These people, are the superior senators. Up to 3 senators can take this position. They are elected by the people of GOUPA. And serve for 3 months. They can be elected again at the next election. These people, approve or veto bills or laws and a majority rule vote, but they first use a graphic organizer to display the positive’s and negative’s of the proposed law.

Senators: These people, are the main body of the senators. Up to 9 senators can take this position. They are elected by the people of GOUPA. And serve for 3 months. They can be elected again at the next election. These people, approve or veto bills or laws by a majority rule vote based upon the graphic organizer by the Head Senators that displays the positive’s and negative’s of the proposed law.

Section C: Judicial Branch

Chief Justice: This one person, is nominated by the President and confirmed by the Senate. They serve for life and can only be removed by death, resignation or impeachment.

Associate Justices: These 3 People, are nominated by the President and confirmed by the Senate. They serve for life and can only be removed by death, resignation or impeachment.

Justices: The number of Justices are determined by the President and confirmed by the Senate. They serve for life and can only be removed by death, resignation or impeachment.

ARTICLE 5, DEMOCRATIC RESPONSIBILITIES

Each Democratic person is responsible for fulfilling their duty to their fullest. If they fail at fulfilling their duties, they can resign or be impeached. The government has many ways of being impeached, including the following; rebellions/revolutions and petitions. Once a rebellion/revolution or petition is presented to the President or Senate (not addressing to the person wanted for impeachment) Then the group can make the final decisions and appoint a replacement or have another election.

Each of the branches of the Government must make a decision on bills proposed by the legislature. If a bill is not vetoed within 48 hours of the proposal by the 3 branches of the government, then the bill will be passed. If there is a fault in the bill after it has been passed, then there must be another bill presented to the legislature to remove the passed bill.

ARTICLE 6, NATIONAL TERRITORY

Section A: General Information

The GOUPA currently has absolutely no territory except for this website and the webs.com website we have. In the future we plan on claiming some servers to call our own.

Section B: Governors and Mayors

ARTICLE 7, NATIONAL LAWS, RIGHTS,  AND PUNISHMENTS

  • Each and every member in the United Penguin Army and the Government Order of the United Penguin Army has the right to their freedom of speech, press, religion, and opinions. This right is limited when it comes to obscenities including sexism, racism, swearing and cursing, violence, and inappropriate actions/topics.
  • Each and every member in the United Penguin Army and the Government Order of the United Penguin Army has the right to call for a court trial when a law is broken, only if the problem can not be solved on their own. The members also have a right to a fair jury if one is available.
  • In any case shall there be any vulgar actions including sexism, racism, swearing, fighting, flaming, cursing, violence, and inappropriate topics/actions unless they are against an enemy. Punishment for civil disputes will result in 2-7 days of suspension.
  • Suspensions are to be a punishment used for minor cases. During a suspension a member is limited to some of their rights.
  • No man is ever above the law. Everyone is punishable by the law.

ARTICLE 8, AMENDMENTS

To be decided by the legislature.

ARTICLE 9, CHECKS AND BALANCES

The government system works by passing and vetoing bills. In order for this to be successful, there must be a system of checks and balances. If the legislature passes a bill and the bill is vetoed by the executives but passed by the judiciary, then that bill will be passed even though the executives vetoed. If the legislature passes a bill and the bill is vetoed by the executives and the judiciary, then that bill will not be passed. That is the system of the checks and balances. This way no section has power above the other.

ARTICLE 10, SUMMARY OF THE NATION

The Government Order of the United Penguin Army is a democracy government system. The president is elected, and the senators are elected as well. No man is above the law, and everyone has an opportunity in participating in the Government Order.
